Analysis of the Supreme Court Ruling on IEEPA Tariffs
The recent decision of the Supreme Court of the United States introduces a new element of complexity into the international trade landscape. The ruling limits the use of the International Emergency Economic Powers Act (IEEPA) as a legal basis for imposing broad-based tariffs, but it does not remove the range of trade instruments available to the US Administration. The immediate response from the White House, activating new legal grounds to maintain a global levy, confirms that tariff policy will remain a strategic pillar in the coming months.
The Basque Government is rigorously analysing the legal and economic implications of this decision, as well as the subsequent actions taken by the US Administration. Caution is advisable: although certain tariffs linked to the IEEPA are no longer in force, the 50% duties on steel and aluminium under Section 232 and the 15% tariff applied to automobiles remain fully in effect, with a direct impact on strategic Basque sectors. Moreover, the possibility of new investigations under other sections of the Trade Act keeps the regulatory outlook in a phase of heightened uncertainty.
