A sign that is suitable to distinguish a product or service in the market (®). When the sign has been registered with the government entity, it is usually referred to as a trademark, and it is shown in its abbreviated form with the symbols ™, MR or ®, although this is not indicative of registration with the competent authority.

The sign of a trademark can be a word or a combination of words, an image or a design, three-dimensional shapes, sounds and, in some countries, smells, textures and any other element that meets the requirements of distinctiveness and possibility of being represented in writing or graphically.

The registration of a trademark gives its owner the possibility of authorizing or prohibiting the use of it by third parties. States generally grant legal protection tools (civil and criminal proceedings) to trademark owners to defend them from unauthorized copies. In Spain they are made up of product or service brands and trade names.
